1. Entirety

These General Terms of Sale constitute the entire agreement between Michaela Buerger and the buyer. By placing an order, the buyer accepts these terms without reservation.

Michaela Buerger reserves the right to modify these Terms at any time. Updated conditions take effect immediately upon publication on the website.

If any condition is missing, it shall be governed by the customary practices of distance selling companies established in France.

2. Purpose

These Terms define the rights and obligations of the parties in connection with the online sale of products offered by Michaela Buerger.

They apply exclusively to purchases made by buyers residing in the countries available in the country selection menu at account creation or checkout.

3. Orders

Orders may be placed online via the catalog and order form available on michaelabuerger.com.

To validate an order, the buyer must:

  • Accept these Terms,

  • Select a delivery address and shipping method,

  • Confirm the chosen payment method.

Placing an order implies acceptance of the product descriptions and prices in effect at the time of purchase. Any disputes relating to these elements will be handled within the framework of the guarantees described below.

Michaela Buerger reserves the right to suspend or cancel any order in the event of non-payment, incorrect information, or unresolved issues related to a previous order.

If a product becomes unavailable after an order is placed, the buyer will be informed by email and may choose to cancel the order and receive a refund.

4. Electronic Signature

The provision of payment information and confirmation of an order constitutes the buyer’s electronic signature and acceptance of:

  • Payment of the amounts due,

  • The terms of the order,

in accordance with French law of March 13, 2000.

5. Order Confirmation

An order confirmation email is sent once the order is validated. This confirmation includes order details, delivery information, potential availability notices, and the order number.

6. Proof of Transaction

Electronic records maintained securely by Michaela Buerger constitute proof of communications, orders, and payments. Orders and invoices are archived on a durable medium and may be produced as evidence.

7. Product Information & Availability

Products sold on michaelabuerger.com are offered subject to availability.

Descriptions and photographs are provided with the greatest possible accuracy; however, minor variations may occur. Photographs are non-contractual.

Availability & Production

Products may be offered as:

  • Ready-to-ship

  • Made-to-order

  • Custom-made (on demand)

The applicable status, along with estimated production and delivery timelines, is clearly indicated on each product page. By placing an order, the buyer acknowledges and accepts these timelines.

8. Prices

Prices are shown in the applicable currency depending on the buyer’s location. Michaela Buerger reserves the right to modify prices at any time but applies the prices in effect at the time of order confirmation.

Free Shipping

Complimentary shipping is offered on orders over €300, as indicated on product pages and at checkout. This condition may vary by destination and will be confirmed before payment.

Shipping & Currency

  • European Union: Prices in EUR, VAT included. Orders are shipped Delivered Duty Paid (DDP).

  • United States: Prices in USD. Orders within the EU are shipped Delivered Duty Paid (DDP).
    Prices include VAT, and no additional duties or taxes will be charged upon delivery.

  • United Kingdom: Prices in GBP. VAT and import duties are not included unless otherwise specified.

  • Switzerland: Prices in CHF. Swiss VAT and customs duties are not included.

  • Canada: Prices in CAD. Local taxes and duties are not included.

  • Rest of the World: Prices in local currency where applicable. Customs duties and local taxes may apply.

Shipping costs are calculated and displayed at checkout unless free shipping applies.

9. Customs

For destinations outside the European Union where DDP is not specified, customs duties, taxes, and clearance fees may apply and are the responsibility of the buyer. Michaela Buerger cannot be held responsible for such charges.

10. Payment

Payment may be made using any method available on the website at the time of purchase.

The buyer guarantees authorization to use the selected payment method. Michaela Buerger reserves the right to suspend or cancel an order in case of payment refusal or unresolved disputes.

11. Delivery & Dispatch

Delivery occurs only after payment confirmation.

Dispatch Times

  • Ready-to-ship items: dispatched within 2–4 business days

  • Made-to-order / custom-order items: dispatched once production is complete, as indicated on the product page

Estimated delivery times:

  • France: 2–4 business days

  • International: 5–12 business days depending on destination

If delivery is significantly delayed, the buyer may request cancellation in accordance with applicable law.

12. Delivery Conditions

Orders are delivered via trusted courier services to the address provided by the buyer.

The buyer is responsible for verifying the condition of the package upon delivery. Any visible damage must be reported within 3 days.

13. Delivery Errors

Any claims relating to delivery errors or non-conforming products must be sent to eshop@michaelabuerger.com within a reasonable time after receipt.

14. Product Warranty

Products benefit from legal guarantees of conformity and against hidden defects in accordance with French law.

This warranty does not cover damage resulting from misuse, improper care, or normal wear.

15. Right of Withdrawal

In accordance with Article L221-18 of the French Consumer Code, buyers have 14 days from receipt to exercise their right of withdrawal.

Made-to-order and pre-order items are excluded from the right of withdrawal, in accordance with Article L221-28, unless defective.

Returned items must be unworn, unwashed, and in their original condition with all tags and packaging.

16. Returns & Refunds

Returns must be authorized by contacting eshop@michaelabuerger.com.

Refunds are processed within 14 working days after receipt and inspection of returned items. Shipping costs and customs fees are non-refundable.

17. Disputes

Any disputes not resolved amicably shall be submitted to the competent courts.

18. Force Majeure

Neither party may be held liable for delays or failures caused by events beyond their reasonable control, including but not limited to natural disasters, supply chain disruptions, production delays affecting artisan workshops, strikes, or transport interruptions.

If such an event lasts more than three months, Michaela Buerger may terminate the contract.

19. Partial Invalidity & Non-Waiver

If any provision is deemed invalid, the remaining provisions remain in force. Failure to enforce a provision does not constitute a waiver.

20. Applicable Law

These Terms are governed by French law. Buyers may request mediation before initiating legal proceedings.
